Return Policy
All Chris Industries quotations are subject to change without notice, subject to prior sale, and unless otherwise noted, are for immediate acceptance. All sales are made subject to availability at time of order, subject to strikes, accidents, or other causes beyond our control. Cancellation on special orders and fabrication orders is not permitted without written consent.
Any metal prices quoted — including, but not limited to, aluminum, copper, steel, zinc, tin, brass, and lead — are quoted “price-in-effect” and are not valid for more than one day unless otherwise specified.
- Items can be returned within 30 days of purchase. We will refund the purchase price, less shipping & handling costs, plus a restocking fee at our discretion.
- Email sales@chrisind.com or call (800) 356-7922 to receive an RA# prior to return shipment. Please keep the tracking number of returned shipments.
- A refund or in-house credit will be issued within 15 days of the return. We are not responsible for non-delivery or damage during return shipping.
- Merchandise must be in a condition to be re-sold as prime material. Refunds cannot be processed for items returned in poor condition.
- Fabricated items, some roll-formed products, and special-order items are non-returnable.
Terms & Conditions of Sale
The following is a summary of the principal terms governing sales by Chris Industries, Inc. (“Seller”). The complete Terms and Conditions accompany every quote and order confirmation and control in all cases.
1. Complete Agreement
These Terms are incorporated into every quote, order, or shipping request accepted by Seller and represent the final and complete agreement of the parties. Terms in a Buyer's documentation are not binding on Seller unless consented to in writing by an officer of Seller.
2. Quotes and Orders
Orders are accepted by Seller's written sales order confirmation. Buyer is responsible for the accuracy of submitted specifications. Quotes are subject to change based on prices in effect when the order is placed and are valid for up to 14 days from the quote date (metal prices are price-in-effect, as above).
3. Cancellation
No order may be cancelled or changed by Buyer except with Seller's express written consent, which may be conditioned upon a cancellation fee. Special-order goods may be cancelled by Seller without liability if they cannot be produced.
4. Delivery
Delivery dates, shipping dates, and lead times are non-binding estimates. Goods not picked up within 30 days of notification may incur storage fees or be returned to inventory.
5. Risk of Loss and Title
Risk of loss passes to Buyer when Seller tenders delivery (at Seller's place of business or Buyer's designated location). Title passes upon payment in full of all amounts owed.
6. Shortage and Nonconforming Claims
Claims for shortages or nonconforming goods must be made in writing within 10 days of delivery, after which the goods are deemed accepted. Upon a valid claim, Seller will provide conforming goods or refund the purchase price.
7. Purchase Price and Payment
Prices exclude taxes, freight, delivery, and insurance, which are Buyer's responsibility. Invoices are due within 30 days. Late amounts accrue a 1.5% late fee and 18% annual interest (or the maximum permitted by law), plus costs of collection including reasonable attorneys' fees.
8. Warranties and Liability
Except for applicable manufacturers' written warranties, goods are sold with all warranties disclaimed to the fullest extent permitted by law. Seller's total liability is limited to the purchase price of the goods on the relevant order; consequential, incidental, and similar damages are disclaimed.
9. Returns
Goods may be returned at Seller's discretion per the Return Policy above. Non-stock and fabricated items are not returnable.
10. Governing Law and Disputes
Disputes are subject to the exclusive jurisdiction and venue of the Circuit Court of Cook County, Illinois. The prevailing party in any controversy is entitled to recover reasonable attorneys' fees and costs. Buyer waives trial by jury.
